1. Scope of Services
Colart provides professional creative and digital services according to the package, proposal, quotation, or agreement signed with each client.
Services may include:
- Digital Marketing & Strategy
- Social Media Management
- Graphic Design & Branding
- Content Creation & Production
- Photography & Videography
- Meta Ads & Google Ads Management
- Website Design & Development
- SEO & Digital Optimization
- Other creative or digital services agreed upon in writing
Any service outside the agreed scope may be subject to additional fees.
2. Client Responsibilities
The Client must provide Colart with all necessary information, materials, brand assets, access credentials, feedback, and approvals required to complete the agreed services.
The Client is responsible for ensuring that any materials provided to Colart, including images, videos, logos, music, trademarks, and other content, are legally authorized for use.
3. Content Review & Approval
Clients are provided with 48 hours to review submitted content or deliverables and request reasonable modifications.
Delays in providing feedback or approval may result in corresponding delays to the content calendar, campaign, project, or delivery date.
Once a deliverable receives final approval, additional modifications may be considered a new revision and may incur additional fees.
4. Payments
All fees, payment schedules, and payment methods are established in the relevant quotation, proposal, invoice, or service agreement.
Payments must be made according to the agreed schedule.
If payment remains outstanding for more than 5 days after the invoice due date, Colart reserves the right to:
- Suspend ongoing services.
- Pause advertising campaigns managed by Colart where applicable.
- Postpone unpublished content.
- Suspend work scheduled for the following service period.
- Resume services only after outstanding amounts are settled.
5. Advertising Budgets
Unless specifically stated otherwise, advertising budgets paid to platforms such as Meta or Google are separate from Colart's management fees.
The Client remains responsible for the agreed advertising budget and any third-party platform charges.
6. Intellectual Property
The Client retains ownership of materials and intellectual property originally supplied by the Client.
Colart retains ownership of its internal methodologies, templates, systems, working files, concepts, processes, and proprietary resources.
Rights to use final approved deliverables are granted according to the applicable agreement and after all related payments have been completed.
Colart may showcase completed work in its portfolio, website, social media, presentations, and promotional materials unless otherwise agreed in writing.
7. Confidentiality
Colart and the Client must maintain the confidentiality of private business information, credentials, strategies, documents, pricing information, and other confidential materials exchanged during the business relationship.
8. Third-Party Platforms
Colart may use third-party platforms including Meta, Google, hosting providers, domain registrars, social media networks, advertising platforms, and other technology providers.
Colart cannot guarantee the continuous availability, policies, algorithms, approvals, account status, or performance of third-party platforms.
9. Performance & Results
Colart will provide services professionally and according to the agreed strategy and scope.
However, marketing performance may depend on factors outside Colart's control. Therefore, specific results such as sales, followers, reach, leads, website rankings, engagement, or advertising performance cannot be guaranteed unless explicitly stated in writing.
10. Right to Refuse or Terminate Services
Colart reserves the right to refuse, suspend, or terminate services involving:
- Illegal or fraudulent activities.
- Content that violates applicable laws or third-party rights.
- Harmful or seriously misleading content.
- Material that creates significant legal or reputational risk.
- Religious or political material that falls outside Colart's accepted service policy.
- Harassment, hate speech, discrimination, or abusive conduct.
- Serious or repeated violation of Colart's terms.
Outstanding fees for work already completed remain payable following termination.
11. Project Delays
Colart is not responsible for delays caused by:
- Late client approvals.
- Missing materials or information.
- Delayed payments.
- Third-party platform issues.
- Technical failures outside Colart's reasonable control.
- Events or circumstances beyond Colart's reasonable control.
Project timelines may be adjusted accordingly.
12. Cancellation & Refunds
Cancellation and refund conditions are determined by the specific service agreement.
Unless expressly stated otherwise in writing, fees covering work already completed, resources already committed, or third-party expenses are non-refundable.
13. Governing Law
Colart's agreements and Terms of Service are governed by the applicable laws of the Republic of Lebanon.
Any dispute that cannot be resolved amicably shall be handled by the competent courts specified in the applicable agreement.
14. Changes to the Terms
Colart may update its Terms of Service when necessary to reflect changes in its services, policies, legal requirements, or business operations.
Material changes affecting an active contractual relationship should be communicated to the Client where applicable.
15. Acceptance
By signing an agreement, approving a proposal, making a payment, or otherwise formally engaging Colart's services, the Client acknowledges and accepts the applicable Terms of Service.
